Protecting your privacy and personal data is a matter of great importance to us. The collection and use of your data are therefore always carried out in accordance with the provisions of the General Data Protection Regulation (EU) 2016/679 (GDPR), the German Federal Data Protection Act (BDSG), and the German Telemedia Act (TMG). Below, we—as the entity responsible for data processing—inform you about which data we collect and how we process this data.
 

1. Personal Data

Personal data within the meaning of the GDPR is any information relating to an identified or identifiable natural person. A natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or one or more specific factors expressive of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. Personal data is stored only to the extent necessary to provide the booked service, to comply with legal requirements, or for the purposes stated below.
 

2. Anonymized Data / Log Files

You can visit our website without the need for collecting personal data. However, certain anonymized data is stored each time you visit our website, such as which page or offer was accessed. This data is not personal and therefore does not fall under the legal regulations of the GDPR or the BDSG.

The website operator or page provider collects data about access to the site and saves it as "server log files." The following data is logged:

  • Visited website

  • Time at the moment of access

  • Amount of data sent in bytes

  • Source/reference from which you reached the page

  • Browser used

  • Operating system used

  • IP address used

The collected data is used solely for statistical analysis and to improve the website. However, the website operator reserves the right to review the server log files retrospectively should concrete evidence point to unlawful use. The collection of anonymous data occurs solely for statistical evaluation to improve our services. Please refer to the section "Right to Information / Right of Withdrawal."
 

3. Purpose of Collecting Personal Data

The collection of personal data becomes essential when you book a room or other service via our website, contact us, subscribe to our newsletter, or wish to use other offers on our site that require the processing of personal data.

In accordance with legal regulations and the principle of data minimization, generally, only such data is collected as is required for the provision of that specific service. Insofar as we request further information in our forms, providing it is always voluntary and marked as such.

The temporary storage of the IP address by the system is necessary to enable the delivery of the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session. Furthermore, storage in log files is necessary to ensure the functionality of the website. Additionally, we use the data to optimize the website and to ensure the security of our information technology systems. Data is not evaluated for marketing purposes in this context. These purposes represent our legitimate interest in data processing according to Art. 6 (1) (f) GDPR.

In the case of booking a room or other service, the data collected is used for the processing of this booking, for advertising purposes within the scope of legal requirements, and for statistical purposes.

The legal basis for sending the newsletter following the sale of goods or services is § 7 (3) UWG (German Act Against Unfair Competition). If you subscribe to our newsletter, we also store and use the data you provided during booking regarding your person and your trip, based on Art. 6 (1) (f) GDPR, in order to provide you with the best possible service as a newsletter subscriber.

The legal basis for the processing of data after the user has registered for the newsletter, provided the user has given their consent, is Art. 6 (1) (a) GDPR.

Furthermore, we use the stored personal data for maintaining customer relationships, customer support (e.g., information about the sequence of your stay), customer satisfaction surveys, and order processing.
 

4. Legal Basis for Processing Personal Data

Where we obtain the consent of the data subject for processing operations of personal data, Art. 6 (1) (a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. For the processing of personal data necessary for the performance of a contract to which the data subject is a party, Art. 6 (1) (b) GDPR serves as the legal basis. This also applies to processing operations required to carry out pre-contractual measures.

Insofar as the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Art. 6 (1) (c) GDPR serves as the legal basis.

In the event that vital interests of the data subject or another natural person make it necessary to process personal data, Art. 6 (1) (d) GDPR serves as the legal basis. If processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, and such interests are not overridden by the interests, fundamental rights, and freedoms of the data subject, Art. 6 (1) (f) GDPR serves as the legal basis for the processing.
 

5. Disclosure of Personal Data to Third Parties

Your personal data will only be disclosed within the framework of relevant legal requirements, in particular those pertaining to data protection and competition law. Insofar as this is necessary for the provision of the contractual service owed by us or for legal obligations, your data will also be disclosed to subcontractors or service providers for the provision of the service in our name or on our behalf (e.g., technical handling of mail and email delivery, payment processing, customer service).

Furthermore, data is disclosed to persons or companies for the processing of your booking, in particular to DIRS21, car rental companies, authorities, etc. Please note that data protection regulations at the registered office of these persons and companies may differ from those in Germany. Disclosure and transmission of your data to third parties also occur if we are legally obligated to do so or due to a legally binding court decision.

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format. Furthermore, you have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.
 

6. Storage and Deletion of Data

Your personal data is stored within the framework of the purposes mentioned under the point "Purpose of Collecting Personal Data." The personal data of the data subject will be deleted or blocked as soon as the purpose of storage ceases to apply. Storage may also take place if this has been provided for by the European or national legislator in EU regulations, laws, or other provisions to which the controller is subject. The legislator has enacted a variety of storage obligations and retention periods. Data will also be blocked or deleted if a retention period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or performance of a contract.
 

7. Use of Cookies

We use cookies (small computer files with text information that the web server sends to your internet browser) to improve your experience when visiting our online services. For example, some notices only appear once if you allow us to set a cookie. In addition, our cookies have an expiration date. If you delete your cookies manually before they expire, you will receive a new one upon your next visit to the site, unless you block the storage of the cookie. 9. Use of Google Maps

10. Security, Questions, and Suggestions, Controller

Security also depends on your own system. You should always treat your access information confidentially, never allow your web browser to save passwords, and close the browser window when you finish your visit to our website. This makes it more difficult for third parties to access your personal data. Use an operating system that can manage user rights. Set up multiple users on your system for family members, and never use the internet under administrator rights. Use security software such as virus scanners and firewalls, and keep your system continuously up to date.

11. Right to Information / Right of Withdrawal; Further Rights of Data Subjects

You have the right:

  • According to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data (if not collected by us), as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;

  • According to Art. 16 GDPR, to request the immediate rectification of inaccurate or completion of your personal data stored by us;

  • According to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims;

  • According to Art. 18 GDPR, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is contested by you, the processing is unlawful but you oppose its erasure, and we no longer need the data, but you require it for the establishment, exercise, or defense of legal claims, or you have objected to the processing according to Art. 21 GDPR;

  • According to Art. 20 GDPR, to receive your personal data, which you have provided to us, in a structured, commonly used, and machine-readable format or to request the transmission to another controller;

  • According to Art. 7 (3) GDPR, to withdraw your once-granted consent to us at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future; and

  • According to Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority for your habitual residence, place of work, or our company headquarters.
